Another Round-Up: Recent Auto Injury Case Wins

It’s been a busy two weeks since our last round-up, and our Michigan auto accident attorney has closed several new cases we’re proud to share. As always, we’re incredibly grateful for our dedicated legal team, who work tirelessly to bring justice and fair compensation to our clients.


Pain and Suffering Case Win – A Question of Fault

Our first case involved a serious motor vehicle accident where our client was struck when an oncoming driver suddenly attempted a left turn across their path. With no time to react, our client was hit head-on and suffered multiple serious injuries.

The defendant denied fault and tried to shift the blame, claiming they didn’t see our client and suggesting our client may have been speeding. Unfortunately, this is a common defense tactic— even when there is a traffic citation, a police report assigning fault, and eyewitness accounts.

Fortunately, our personal injury lawyer was fully prepared. He identified multiple inconsistencies in the defendant’s deposition and highlighted the discrepancies between the defendant’s testimony and the statements recorded by the responding police officer. He also deposed an eyewitness who confirmed the defendant was, in fact, at fault.

Once liability was firmly established, we negotiated a pain and suffering settlement that fully compensated our client for their injuries and emotional distress.


Personal Injury Protection Win – Out-of-State Accident

Our next case involved an out-of-state motor vehicle accident. Our client was visiting loved ones in Minnesota when another driver lost control while merging and collided with them on the highway.

This case provides an interesting conundrum. While many would assume to call a local attorney, auto insurance policies vary greatly from state to state. In Michigan, we operate under a no-fault insurance system, meaning your own insurer pays for medical expenses, attendant care, replacement services, and wage loss benefits —regardless of who caused the accident.

Only twelve states in the U.S. have no-fault systems, and even among those, the specific rules differ. That’s why it’s critical to work with an experienced Michigan personal injury attorney who understands the nuances of no-fault insurance claims.

Fortunately, our team was able to provide that expertise and successfully litigated our client’s personal injury protection (PIP) claim to a fair and just settlement. 


Uninsured Motorists Coverage Win – An Unresponsive Defendant

Our third case from the past two weeks involved a serious motor vehicle accident on I-75, where our client was struck without warning by another driver. The impact caused our client to lose control and collide with the center wall, resulting in significant vehicle damage and injuries.

Although the police report initially stated that the at-fault driver had valid auto insurance, the defendant failed to respond to the complaint in a timely manner. Our legal team quickly placed the defendant in default but continued investigating to determine whether the driver actually had coverage—an essential step in ensuring there was probable collectability for our client’s pain and suffering claim.

If the driver was uninsured, it was okay, but we still needed formal proof to activate our client’s uninsured motorist (UM) coverage. To verify this, we hired a professional investigation company, which confirmed that the defendant did not, in fact, have valid auto insurance.

Once that was established, our client’s own insurance company stepped in to negotiate under the uninsured motorist provision of their policy. This ultimately led to a successful settlement and fair compensation for our client’s injuries and losses.


Auto Accident Case Win – A Question of Residency

The final case we’d like to highlight involved a motor vehicle accident in which our client was rear-ended at a stop sign, suffering serious injuries and accumulating substantial medical bills.

The key issue in this case was whether our client’s personal injury protection policy covered them, as they split their time between Michigan and another state. The insurance company argued that our client’s primary residence—or “domicile”—was outside Michigan, and therefore they were not covered under their Michigan policy.

To resolve this, our attorney devoted extensive time investigating the matter, reviewing lease agreements, pay stubs, and other documents, while also consulting with our client and their family. This was in addition to the usual investigation into the pain and suffering claim against the at-fault driver.

Although the process was detailed and time-consuming, our auto accident lawyer successfully proved the client’s Michigan residency and secured a settlement on their behalf.
