This Week’s Round-Up: 3 Michigan Personal Injury Case Wins

It’s been a few weeks since our last round-up, and there’s no time like the present to highlight some of the victories our personal injury team achieved this past week. Our office has been working diligently on behalf of our clients, and it’s incredibly rewarding to see long-awaited justice finally delivered—especially for those who have been navigating the legal process for an extended period of time. These outcomes allow our clients to move forward and begin the healing process with greater peace of mind, so we are proud of the work.


A Multi-Accident PIP Victory

The first case we want to spotlight involved two separate motor-vehicle accidents: one in 2022 and another in 2023. While the bodily injury (BI) claims related to both crashes were previously litigated and successfully settled, the personal injury protection (PIP) claim remained unresolved.

At one point, our client’s insurance company prematurely terminated our client’s PIP benefits, leaving them responsible for thousands of dollars in outstanding medical bills—with the balance continuing to grow due to ongoing treatment.

One of the biggest challenges in this case was the extensive number of medical providers involved. Our client was treating with multiple specialists, which required continuous communication to ensure we had accurate and up-to-date medical records and billing statements. Staying organized in cases like this is critical, as it allows us to properly value a Michigan PIP claim during negotiations and ensure our client is fully compensated.

Another common complication in multi-accident cases is determining which injuries stem from which accident. Insurance companies often attempt to dispute the cause of treatment, especially when medical care overlaps across incidents. Fortunately, in this case, the same insurance company covered both accidents, eliminating some of the usual finger-pointing. Nonetheless, it’s a challenge that frequently arises in Michigan PIP claims and can significantly complicate the process.

On the other hand, one unexpected positive that comes from handling multi-accident cases is the strong relationship that often develops between our team and our clients. These cases typically take longer to resolve, and we are always grateful for our clients’ patience and trust as we work toward the best possible outcome.


A Bodily Injury Claim in a Multi-Passenger Accident

The second case we want to highlight actually involved a family that was T-boned in an intersection, causing their vehicle to flip. Thankfully, their young child seemed to escape without serious injury. However, both parents sustained injuries that required medical treatment and legal support.

One of the primary challenges in this case was that the defendant refused to admit fault throughout the course of litigation. Early in the discovery process, our attorney sends a series of requests for admission, interrogatories, and requests for production. In this case, when asked to admit fault for the crash, the defendant objected.

When liability is disputed like this, it’s critical to take swift action to prevent fault from becoming an issue during settlement negotiations or at trial. To address the problem, our attorney filed a Motion for Summary Disposition, presenting the evidence and requesting that the judge issue a ruling on negligence and fault.

Ultimately, the act of filing the motion and scheduling the hearing prompted the defendant to reevaluate their position and extend a settlement offer. We are grateful that our clients were able to resolve their pain and suffering claims without further litigation as it helps them to begin moving forward with their lives.

As with many multi-passenger accidents, an unexpected positive was the opportunity to work closely with multiple members of the same family. This allowed us to better understand their individual experiences and build a deeper rapport throughout the process.

While the trauma of the crash was understandably more intense because it affected an entire family, it was also that much more rewarding to help them navigate their bodily injury claims and watch them begin recovering—physically, emotionally, and financially.


A Michigan Dog Bite Case

The final case we want to highlight is a bit different. While it wasn’t auto-related, it was still a serious Michigan personal injury claim. Our client was attacked by a dog while visiting their neighbor’s property, resulting in multiple injuries.

One of the biggest challenges in this case was that the defendant initially refused to provide the lawsuit documentation to their insurance company. Although we properly served the defendant in accordance with court rules, the deadline to respond to the complaint came and went without any appearance or answer being filed.

As a result, we were forced to file a Motion for Default Judgment, which ultimately pushed the defendant to notify their insurance company and allow the case to move forward.

In this case—and in all Michigan dog bite claims—we were required to establish that:

  • Our client was lawfully on the defendant’s property, and

  • Our client did not provoke the dog

We were able to successfully prove both elements and litigate the claim on our client’s behalf, achieving a positive result that allowed them to focus on recovery.


Conclusion
